This document provides support to a citizen petition to Prohibit Menthol as a Characterizing Flavoring of Cigarettes and Cigarette Smoke. It outlines the research and legal arguments for such a prohibition through 30 pages of narrative with 174 references. Importantly, it discusses the public health regulation and standards, and the dangers of added menthol. It concludes, “The evidence that the presence of menthol in cigarettes creates unique harms is clear.” It then considers the proposed US FDA rule and actions necessary to maximize the benefits from the rule for both smokers and those exposed to secondhand smoke.
