Note: Thai youth using e-cigarettes can do extensive damage to their respiratory, cardiovascular, and neurological (their brains) systems when becoming addicted to heavy use of e-cigarettes. Since the tobacco and vaping industries target youth, eliminating access to and use of e-cigarettes is essential to protect Thais, especially youth.

Newly “signed legislation will close two loopholes left open by California’s 2022 legislation that restricts sales of most flavored tobacco products, including menthol cigarettes and youth-appealing flavored e-cigarettes. The tobacco industry immediately exploited these loopholes to continue selling flavored tobacco products in the state. Similar loopholes remain in the legislation of other states and federal regulations. Are other states and the US Food and Drug Administration (FDA) set to follow California’s example, or will California’s advance result in an even wider divide in tobacco control in the US?

While Californian legislators have been highly supportive of tobacco control and amended the state’s health code and adjacent legislation to close loopholes, the FDA interprets federal law through its rulemaking process to finalize and implement tobacco product regulations. The US Supreme Court recently overturned its 1984 ruling of Chevron USA Inc v Natural Resources Defense Council, a decision expected to make federal agency rulings more vulnerable to legal challenges. It is uncertain at this time whether Congress will step up to substantially amend the federal Family Smoking Prevention and Tobacco Control Act by adding similar language as California’s bill that will enable the FDA to regulate additional flavored tobacco products and rein in the proliferation of products containing nicotine analogues with unknown health and addiction risks.”

Comment: Closing loopholes regarding flavored tobacco products and synthetic and analogue nicotine is critical to stop tobacco industry efforts to keep new and continuing users addicted. Stephen Hamann
